LogicGate Acceptable Use Policy

Use of the LogicGate Services is subject to this acceptable use policy (this “Acceptable Use Policy”). Unless otherwise indicated, capitalized terms used herein but not defined herein have the meanings ascribed to them in the applicable agreements between Customer and LogicGate governing Customer’s use of the LogicGate Services (the “Agreement”), or if not defined in the Agreement, in the LogicGate Master Services Agreement located at https://www.logicgate.com/msa.

General Use Restrictions

Customer may not:

1. Use the LogicGate Offerings in any way that violates or facilitates the violation of applicable law. This includes:

1.1. Engaging in illegal activity;

1.2. Violating copyright, trademark, or other intellectual property laws;

1.3. Violating any person’s privacy rights, including by attempting to collect, infer, predict, store, process, or disclose protected or personally identifiable information, such as passwords, account information, credit card numbers, addresses, location, or other contact information without a lawful basis for doing so;

1.4. Engaging in the unauthorized practice of any regulated profession, including the financial, legal, or medical/health professions;

1.5. Accessing or authorizing anyone to access the LogicGate Offerings from an embargoed country; or

1.6. Bypass or interfere with any safeguards or controls of LogicGate’s AI features. LogicGate may monitor use for compliance and may remove data that violates this Agreement or applicable law.

2. Use the LogicGate Offerings in any way that could harm them or impair another person’s authorized use of the LogicGate Offerings. This includes:

2.1. Attempting to gain unauthorized access to the LogicGate Offerings, acting to deny others’ authorized access to the LogicGate Offerings, or authorizing any third party to inappropriately access or use the LogicGate Offerings on Customer’s behalf (such as sharing a username and password with multiple individuals);

2.2. Using the LogicGate Offerings to try to gain unauthorized access to any other service, data, account, system, or network by any means; and

2.3. Using content or technology that harms, interferes with, or limits LogicGate’s or any other user’s normal operation of LogicGate’s products and services, including monitoring traffic or data.

3. Use the LogicGate Offerings in any way that is intended to harm others (other than normal competition with third parties). This includes:

3.1. Using the LogicGate Offerings to store, generate, or transmit viruses, malware, malicious code, trojan horses, or anything designed to impair the proper operation of any website or computer system; and

3.2. Using the LogicGate Offerings to harm, threaten, stalk, defame, defraud, deceive, or harass anyone for any reason.

4. Use the LogicGate Offerings to violate LogicGate’s intellectual property rights or otherwise compete with LogicGate. This includes:

4.1. Accessing or using any intellectual property in or related to the LogicGate Offerings, except as expressly permitted under the Agreement;

4.2. Copying the LogicGate Offerings, or any part, feature, function, or user interface thereof, except as expressly allowed for such LogicGate Offerings under the Agreement; and

4.3. Using the LogicGate Offerings to assist in the creation of similar or competitive products or services to be used apart from the Services.

Violations

Customers will report any violations of this Acceptable Use Policy, or any issues with any of the LogicGate Offerings, including the Services and the LogicGate AI Features, to LogicGate’s Legal Department at [email protected].

General Terms

Notwithstanding anything to the contrary in the Agreement, this Acceptable Use Policy (“AUP”) shall govern in the event of any conflict. LogicGate may amend this AUP from time to time upon reasonable notice, which may be provided through the Services or by posting an updated version on the Website. Any violation of this AUP may result in suspension or termination of Customer’s access to the Services or other LogicGate Offerings. Customer shall be responsible for ensuring its Users’ compliance with this AUP and shall not permit or encourage any activity prohibited herein.
